"Please be advised that Rains ISD must follow the school laws of this State. Currently, there is no parental right to “opt out” of standardized tests in Texas. See Tex. Educ. Code § 26.010(a) (“A parent is not entitled to remove the parent’s child from a class or other school activity to avoid a test[.]”). If the student refuses the testing opportunity provided, their test will be submitted for scoring. This could result in the student being placed in required HB 4545 accelerated instruction during the next school year or even during the summer break. In addition, the student’s score would have a negative impact on the district’s accountability rating. If you desire to change this law, then I encourage you to discuss this with your State Representative and Senator, as well as the Texas Education Agency. Rains ISD, however, will continue to administer the legally mandated STAAR assessments."
